The State charged appellant with illegal Investment. A jury found him guilty of the offense. The jury assessed a ten-year sentence and a $50,000 fine. Appellant contends the trial court should have granted a mistrial when the State referred to his failure to testify during the punishment phase. He contends that counsels arguments and the courts comments impermissibly reduced the States burden of proof. He also contends the evidence was insufficient to show that he committed the offense of illegal investment. We conclude the evidence is sufficient to support the conviction. However, we find the States commenting on appellants failure to testify at the punishment phase is reversible error. We sustain appellants first point of error. We reverse the trial courts judgment. We remand the cause to the trial court for a new punishment hearing.
